Terms of Service

By accessing bengalpixel.com or engaging Bengal Pixel for any service, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

Bengal Pixel is an MSME & Silpasathi registered digital agency located at Khila, Amta, Howrah, West Bengal 711410, India.

Bengal Pixel provides the following digital services:

• Website design and development
• Mobile application development
• Graphic design and branding
• Digital marketing and SEO
• AI automation and chatbot development
• QR code generation and management

The scope, timeline, and deliverables for each project are defined in a separate written agreement or proposal shared with the client prior to project commencement.

All projects begin with a discovery call and a written proposal. Work commences only after the client has confirmed the proposal and made the required advance payment as per the agreed payment schedule.

Any scope changes requested after project commencement may be subject to additional charges and revised timelines. Bengal Pixel will communicate any such changes in writing before proceeding.

• Payments are structured as milestones, as specified in the project proposal
• Invoices are due within 7 days of issuance unless otherwise agreed in writing
• Bengal Pixel reserves the right to pause or suspend work if payments are overdue by more than 14 days
• All prices are in Indian Rupees (INR) and inclusive of applicable GST unless stated otherwise

Upon receipt of full and final payment, Bengal Pixel transfers ownership of all custom-developed deliverables (code, designs, content) to the client, unless otherwise agreed in writing.

Bengal Pixel retains the right to showcase completed projects in its portfolio, case studies, and marketing materials, unless the client requests confidentiality in writing.

Third-party assets (fonts, stock images, libraries) are governed by their respective licences. Bengal Pixel will inform the client of any such assets used.

The client agrees to:

• Provide accurate information, content, and feedback in a timely manner
• Designate a point of contact for project communication
• Obtain any necessary licences or permissions for content they supply
• Not use Bengal Pixel's deliverables for unlawful purposes

Bengal Pixel warrants that services will be performed with reasonable skill and care, consistent with industry standards. We provide a 30-day bug-fix warranty after project delivery for issues arising from our development work.

We do not warrant that websites or applications will be error-free or uninterrupted at all times. Bengal Pixel is not liable for issues caused by third-party hosting providers, domain registrars, or changes to third-party APIs.

To the maximum extent permitted by applicable law, Bengal Pixel's total liability to any client shall not exceed the total fees paid for the specific project giving rise to the claim.

Bengal Pixel shall not be liable for indirect, incidental, or consequential damages, including loss of revenue, data, or business opportunity.

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. This obligation survives termination of the agreement for a period of 2 years.

These Terms are governed by the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Howrah, West Bengal, India.

Bengal Pixel reserves the right to update these Terms at any time. Changes will be published on this page with an updated date. Continued use of our services after changes constitutes acceptance.
